Welcome to Tudor Crișan @ AI Build Operator ("we", "our", or "us"). By accessing our website (tudorbuilds.com) or engaging our AI build services, you agree to be bound by these Terms of Service.

1. Scope of Services & AI Engineering

We scope, build, and measure AI builds: LLM workflow automation, leverage-multiplying internal tools, custom AI agent development, and customer-facing AI products.

• Scope Definitions: Specific project deliverables, milestone targets, leverage metrics, and technical architectures are defined in individual Scope of Work (SOW) documents or v1 agreements.
• Iterative Support: Post-delivery technical verification and performance iterations are provided as defined in your engagement contract.

2. Intellectual Property & Code Ownership

• Client Ownership: Upon full payment of project fees, all custom source code, proprietary prompt templates, vector database indexes, and agent workflow scripts created specifically for your organization become your sole intellectual property.
• Pre-Existing Assets: Any core utility libraries, reusable agent boilerplates, or open-source components retained by us remain subject to standard open-source licenses or perpetual non-exclusive client usage licenses.

3. Data Privacy & AI Model Data Integrity

• Zero Third-Party Training: We construct AI integrations using enterprise API parameters that explicitly opt out of training third-party foundation models (such as OpenAI, Anthropic, or Google Gemini) on your proprietary business data.
• Confidentiality: All client data, trade secrets, system credentials, and business logic shared during engagement are protected under strict non-disclosure obligations.

4. Performance Guarantees & Business Metrics

• Leverage Multipliers: While our systems are architected to achieve targeted multiplier leverage (e.g. 5x - 20x efficiency gains), actual financial ROI depends on client adoption, operational execution, and team integration.
• Technical Performance: We guarantee technical compliance of all custom deliverables against agreed-upon performance benchmarks at time of delivery.

5. Third-Party Services & API Dependencies

• Our AI infrastructure relies on third-party service providers (e.g., Vercel, Resend, OpenAI, Anthropic, Calendly, WhatsApp).
• We are not liable for service interruptions, rate limit shifts, or model deprecations imposed by third-party API providers, but we will provide prompt migration assistance under active maintenance retainers.

6. Limitation of Liability

In no event shall Tudor Crișan @ AI Build Operator be liable for indirect, incidental, consequential, or punitive damages arising out of system usage, automated workflow outputs, or third-party service disruptions. Total liability is limited to fees paid under the applicable SOW in the preceding 6 months.
